1. Acceptance of Terms

By downloading, installing, or using Elite (available at eliteapp.run), you agree to be bound by these Terms and Conditions. If you do not agree, please uninstall the app and discontinue use immediately.

2. Description of Service

Elite is a running and outdoor community platform.

As a user, you can:

• Discover events, marathons, and races published by verified organisers
• Post photos, videos, and stories from your runs, races, and adventures
• Pace, comment on, and react to other runners and organisers
• Join paid or free events
• Share event and post links via the eliteapp.run domain

As a verified organiser, you can additionally:

• Create and publish events, races, and marathons
• Publish official routes and import routes via GPX file
• Manage event listings, participants, and event content

Event and route creation is restricted to verified organiser accounts. Standard users cannot publish routes or events on the platform.

3. User Accounts

You may register using email/password, Google, Facebook, or Apple Sign-In. You agree to:

• Provide accurate, current, and complete registration information
• Keep your login credentials confidential
• Notify us immediately of any unauthorised access to your account
• Accept responsibility for all activity that occurs under your account

Accounts found to contain false information may be suspended without notice.

4. Verified Accounts & KYC Verification

A verified account unlocks additional features within Elite. To become verified, you must complete identity verification (KYC) by submitting:

• A government-issued photo ID
• A PAN card (for organiser accounts)
• A registration certificate (for organisers)

KYC submissions are reviewed by Elite administrators. Approval is at our discretion. Rejected submissions will receive a reason via in-app notification, and you may resubmit after correcting the identified issues.

Bypass attempts, fraudulent documents, or false information during KYC will result in permanent account termination.

5. User Content

You retain ownership of all content you post (photos, videos, captions, event listings). By posting, you grant Elite a non-exclusive, worldwide, royalty-free licence to display, store, and distribute your content within the app and for promotional purposes.

Elite is a community for runners and outdoor enthusiasts. Posts should focus on running, marathons, races, training, events, routes, and outdoor adventures. Off-topic content — including politics, religious or ideological messaging, unrelated advertising, and commentary that is not connected to running or outdoor activity — may be removed at our discretion. Repeated off-topic posting may result in account restrictions.

You agree not to post content that:

• Is illegal, obscene, hateful, or discriminatory
• Contains political, religious, or ideological messaging unrelated to running or outdoor sports
• Is unrelated to running, events, races, marathons, routes, or outdoor adventures
• Infringes on the intellectual property rights of others
• Reveals private information about another person without consent
• Is misleading, false, or deceptive
• Contains malware, viruses, or harmful code

We reserve the right to remove any content that violates these terms.

6. Events

Events, marathons, and races on Elite may be free or paid. When creating or joining an event:

• Organisers must provide accurate event details (location, date, difficulty, required gear)
• Organisers are solely responsible for the safety and management of their events
• Participants join events voluntarily and at their own risk
• Elite is not liable for injuries, losses, or damages occurring during events
• Users must honestly assess their physical fitness before registering for any event

Organisers who repeatedly post misleading event information may be removed from the platform.

7. Route Creation & GPX Imports (Verified Organisers Only)

Only verified organiser accounts may create events and publish routes on Elite. When a verified organiser creates an event or route through the Elite app, or imports a route via GPX file, that organiser is the Route Creator. As a Route Creator, you acknowledge and agree that:

• You are solely responsible for ensuring the route complies with all applicable local, national, and municipal laws, land-use regulations, and public or private access rights
• You will observe all road, traffic, and pedestrian safety rules in every area the route crosses
• You must not publish routes that cross private property, protected areas, or restricted zones without authorisation from the relevant authority
• You accept full responsibility for the safety, accuracy, and current condition of any route you publish, import, or share
• You accept full responsibility for any incidents, injuries, damages, disputes, or legal claims arising from routes you create, import, or share — whether affecting yourself, participants, other users, third parties, or property
• Elite acts only as a hosting and discovery platform and does not verify, endorse, or guarantee the legality, safety, accuracy, or condition of any organiser-submitted route
• Users who follow a route created by an organiser do so voluntarily and at their own risk

Elite reserves the right to remove any route that violates these Terms or that we determine, at our sole discretion, may pose a risk to users, third parties, or the public. Repeated violations may result in loss of verified organiser status and account termination.

8. Payments

Paid event features are currently disabled. When enabled, payment processing will be handled by a third-party provider. All payment-related terms will be disclosed prior to any transaction. Elite does not store payment card details.

9. Prohibited Activities

You agree not to:

• Use Elite for any unlawful purpose
• Harass, bully, threaten, or intimidate other users
• Create fake profiles or impersonate real individuals or organisations
• Attempt to gain unauthorised access to other accounts or our systems
• Reverse-engineer, decompile, or scrape the app or its data
• Post spam or unsolicited promotional content
• Interfere with or disrupt the app's operation or servers

10. Intellectual Property

The Elite name, logo, interface design, and original content are owned by Elite and protected by applicable intellectual property laws. You may not copy, reproduce, or redistribute any part of the app without written permission.

11. Account Termination

We may suspend or permanently terminate your account without prior notice if you:

• Violate any provision of these Terms
• Submit fraudulent KYC documents
• Engage in conduct harmful to other users or the platform
• Are found to have created multiple accounts to circumvent a ban

Upon termination, your right to use the app ceases immediately. Content you posted may remain visible at our discretion.

12. Disclaimers

Elite is provided "as is" without warranties of any kind, express or implied. We do not guarantee:

• The accuracy or completeness of event or route information
• Uninterrupted or error-free service
• The safety of any route or event condition
• The actions or trustworthiness of other users

Always exercise personal judgement and take appropriate safety precautions when participating in running or outdoor activities.

13. Limitation of Liability

To the maximum extent permitted by law, Elite and its team members shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the app, including but not limited to personal injury during events, marathons, races, or route activities.

14. Governing Law

These Terms are governed by the laws of Nepal. Any disputes arising from use of Elite shall be subject to the jurisdiction of the courts of Nepal.

15. Changes to Terms

We may update these Terms at any time. We will provide at least 7 days notice of material changes via in-app notification or email. Continued use of Elite after the effective date of changes constitutes your acceptance of the revised Terms.
